2. Scope
These terms apply to the use of the FitStart Group website as well as to the use of digital content and Learning Experiences provided by FitStart Group.
Digital products may be offered to customers in different countries. The products available in a particular country are determined by the respective offer and checkout.
Additional or differing terms of sale of the respective payment or distribution partner may apply to the actual purchase transaction.
3. Contracting Party for Purchases via FastSpring
Digital products and Learning Experiences from FitStart Group may be purchased via FastSpring.
For purchases processed through FastSpring, FastSpring acts as the Merchant of Record and seller to the customer. The purchase and payment processing are subject to the terms of sale displayed in the FastSpring checkout.
FitStart Group is the provider and publisher of the respective digital content and is responsible for its provision and use in accordance with these terms.
4. Offers and Prices
The products, content, prices and availability displayed on the website may vary depending on the country, currency and market.
The final price applicable to a purchase is displayed in the respective checkout before the order is completed. Applicable taxes may be calculated depending on the customer's country and applicable legal requirements.
For purchases processed through FastSpring, FastSpring, as Merchant of Record, is responsible in particular for payment processing and for calculating, collecting and remitting applicable sales taxes and/or value-added taxes.
5. Digital Products and Learning Experiences
FitStart Group offers digital Learning Experiences and other digital content.
Unless expressly stated otherwise for the respective product, the purchase is a one-time purchase and not a subscription.
The specific scope of a Learning Experience is determined by the respective product or offer description at the time of purchase.
6. Provision and Access
After successful completion of the purchase, access to the purchased digital product is provided through the customer account used with FitStart Group.
As a general rule, the same email address used for the purchase must be used to access the product.
Technical access is activated after successful confirmation of the purchase. In exceptional cases, access may be delayed due to technical checks or disruptions.
7. Right of Use
By purchasing a digital product, the customer receives a personal, non-exclusive and non-transferable right to use the purchased content for their own private purposes.
In particular, sharing personal access with third parties, reproducing or redistributing the content, making the content publicly available, or using it commercially is prohibited unless FitStart Group has expressly agreed otherwise in writing.
All copyrights, trademarks and other intellectual property rights relating to the content remain with FitStart Group or the respective rights holders.
8. Availability and Further Development
FitStart Group strives to ensure reliable availability of its digital content. However, continuous, uninterrupted or error-free availability cannot be guaranteed.
FitStart Group may further develop, update or adapt content for technical or editorial reasons, provided that this does not unreasonably impair the essential nature and benefit of a product already purchased.
Temporary restrictions may occur due to maintenance, technical disruptions or circumstances beyond FitStart Group's control.
9. Refunds and Right of Withdrawal
Refunds and rights of withdrawal are governed by the statutory provisions applicable to the respective purchase as well as by the terms of the seller or Merchant of Record used for the transaction.
For purchases made via FastSpring, payment and refund transactions are processed through FastSpring.
Additional information from FitStart Group is available in the current withdrawal and/or refund policy on the website.
10. Liability
FitStart Group prepares its digital content with reasonable care. The content is intended to provide information, guidance and support for personal development and does not guarantee any particular personal, professional, health-related or other outcome.
To the extent permitted by law, FitStart Group shall not be liable for indirect damages, consequential damages or damages resulting from improper use of the content provided.
Mandatory statutory liability provisions remain unaffected.
11. External Services
Third-party services may be used to provide the website, payment processing, customer accounts and other functions.
The terms and privacy policies of the respective provider may additionally apply to individual services.
12. Changes to These Terms
FitStart Group may amend these terms and conditions of business and use where necessary due to legal, technical or business changes.
Changes do not apply retroactively to purchases already completed unless permitted by law or expressly agreed.
13. Applicable Law and Jurisdiction
The legal relationship between FitStart Group and the user is governed by Swiss law, unless mandatory consumer protection provisions of the country in which the user has their habitual residence provide otherwise.
To the extent permitted by law, the place of jurisdiction is the registered place of business of FitStart Group in Switzerland.
